15. Service-Specific Clauses for Solar Energy Solutions
A. Installation and Site Access
-
Customer Responsibilities: You agree to provide Utah Clean Power and its contractors with timely access to your property for site assessments, installation, maintenance, and any related services.
-
Site Conditions: You are responsible for ensuring that the site where the solar system will be installed is safe and free from obstructions, hazards, or conditions that might impede the installation process.
-
Permits and Approvals: Utah Clean Power will assist in obtaining necessary permits, but you must ensure that any required homeowner's association (HOA) approvals, building permits, or other local government approvals are secured prior to installation.
B. Changes to Installation
-
Modifications: Any requested changes to the original installation plan (e.g., location of solar panels, equipment changes) must be approved by Utah Clean Power and may result in additional costs. Utah Clean Power reserves the right to modify installation timelines based on unforeseen site conditions or regulatory requirements.
-
Force Majeure: Utah Clean Power is not responsible for delays caused by factors beyond our control, including but not limited to severe weather, supply chain issues, or local regulatory delays.
C. Energy Output and Performance Guarantees
-
Estimated Energy Output: Any estimates provided regarding energy output or cost savings from solar installations are based on historical data, available sunlight, and other environmental factors. Actual results may vary due to weather, shading, and other site-specific conditions.
-
Performance Monitoring: Utah Clean Power may offer performance monitoring services, but it is the customer’s responsibility to inform us of any system underperformance or issues promptly. Performance monitoring may be subject to third-party terms and conditions.
D. Warranties
-
Product Warranty: Equipment provided as part of the solar installation (e.g., panels, inverters) is covered by the manufacturer's warranty, which may vary by component. Warranty claims are subject to the terms provided by the manufacturer.
-
Service Warranty: Utah Clean Power may provide a limited warranty for workmanship and installation services. Any issues caused by improper installation will be corrected at no additional cost within the warranty period, as long as the system has not been altered or tampered with by the customer or a third party.
E. Maintenance and Upkeep
-
System Maintenance: Regular maintenance of the solar system (e.g., cleaning, inspection) may be required to ensure optimal performance. Utah Clean Power may offer maintenance services or recommend third-party providers, but the customer is ultimately responsible for upkeep unless a maintenance agreement is in place.
-
Unauthorized Modifications: Any modifications to the solar energy system not performed or authorized by Utah Clean Power will void the service and equipment warranties.
F. Liability for Damages
-
Damage During Installation: Utah Clean Power takes all reasonable precautions to avoid damage to your property during installation. In the unlikely event that damage occurs due to our negligence, we will repair the affected area.
-
Pre-Existing Conditions: Utah Clean Power is not responsible for repairing or replacing any pre-existing issues with your roof, wiring, or structure that may be discovered during the installation process. If such conditions are identified, you may be required to address them before installation can proceed.
G. Transfer of Ownership
-
Solar System Ownership: Once the solar system has been installed and final payment has been made, ownership of the system is transferred to you, the customer. If you sell your property, it is your responsibility to inform the buyer of the solar system’s ownership and any ongoing maintenance requirements.
-
System Relocation: If you relocate and wish to move the solar system to a new property, any disassembly, relocation, and reinstallation will incur additional charges. Utah Clean Power will provide a quote for such services upon request.
H. Energy Rebates and Incentives
-
Eligibility: Utah Clean Power will assist you in understanding available rebates and tax incentives, but it is your responsibility to ensure you meet eligibility requirements.
-
Documentation: Utah Clean Power may assist in providing the necessary documentation for rebate applications, but the ultimate responsibility for filing and securing rebates rests with the customer.

-
Utility Coordination: Utah Clean Power will coordinate with your utility company to connect the solar energy system to the grid. You are responsible for complying with any utility-specific requirements and agreements, including net metering arrangements.
-
